Copyright Policy

This policy explains how Loudkite reviews infringement complaints, handles disputed material, and responds when users repeatedly upload or offer content they do not control.

1. Respect for intellectual property

Loudkite expects users to upload, post, message, offer, and license only content they are authorized to use. We may remove or disable access to material that appears to infringe copyright, trademark, publicity, or other proprietary rights.

2. Filing an infringement notice

If you believe content on Loudkite infringes your rights, send a detailed notice to copyright@loudkite.com. Include enough information for us to identify the material and evaluate the claim promptly.

  • Your name, company name if applicable, mailing address, phone number, and email address.
  • Identification of the copyrighted work or other protected material you claim has been infringed.
  • The specific Loudkite URL, listing, profile, post, message thread, or asset path you want reviewed.
  • A statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law.
  • A statement that the information in your notice is accurate and, where required by law, made under penalty of perjury.
  • Your physical or electronic signature.

3. Counter-notices

If your content was removed and you believe that happened by mistake or misidentification, you may submit a counter-notice. We may restore material when the law permits and when the underlying claimant does not escalate the matter within the required timeframe.

  • Identify the removed material and where it appeared before removal.
  • Explain why you believe the takedown was mistaken or improper.
  • Provide your name, address, phone number, email address, and signature.
  • Include any statements required by applicable law for a valid counter-notice.

4. Repeat offenders and marketplace restrictions

Loudkite may terminate repeat offenders, reject future uploads, suspend messaging, remove listings, cancel settlements, or withhold marketplace access where infringement risk is repeated or severe.

We may also preserve copies of notices, counter-notices, moderation records, and related account information for legal, audit, and safety purposes.

5. False claims

Submitting false, misleading, or bad-faith claims or counter-notices may expose you to legal liability and platform enforcement. Only submit notices when you are authorized to act and have reviewed the relevant facts carefully.

6. Additional rights review

Some disputes involve split ownership, sample clearance, trademark rights, personality rights, or contract restrictions rather than straightforward copyright questions. Loudkite may request extra documentation, pause a listing, or decline to restore content until the parties resolve the issue.
